Terms and Conditions for Sale of Original Artwork

These Terms and Conditions (“Terms”) govern the sale of original artwork by Peyton Quinn Baker (“Artist,” “we,” or “us”) to the purchaser (“Buyer,” “you,” “your”).
By purchasing artwork through this site or by direct sale, you agree to be bound by these Terms.
1. Sale and Transfer of Ownership
Upon full payment, the Buyer acquires ownership of the physical artwork listed in the transaction.
Ownership of the physical object transfers to the Buyer once the artwork has been paid in full and shipped (or if collected in person).
The Artist retains all copyright and intellectual property rights to the artwork unless otherwise expressly agreed in writing.
2. Description of Artwork
The artwork is sold “as described” on the sales page, including title, medium, year, and dimensions.
While the Artist endeavors to describe works accurately, the Buyer is responsible for reviewing all details before purchase.
3. Price, Payment, and Taxes
Prices listed are in USD and include all fees unless otherwise noted.
Buyers are responsible for any applicable taxes required by law.
Buyers agree to make full payment by the agreed method (Stripe, bank transfer, etc.) prior to transfer of ownership.
4. Shipping, Delivery & Risk
The Buyer is responsible for shipping costs unless otherwise agreed.
Risk of loss or damage transfers to the Buyer once the artwork leaves the Artist’s possession or a carrier is engaged.
The Artist is not responsible for damage caused by a shipping carrier once the work is in transit.
5. Returns & Refunds
Original artwork is non-refundable.
All sales are final once payment has been processed, due to the one-of-a-kind nature of each work.
6. Copyright & Reproduction Rights
The Buyer does not acquire copyright or reproduction rights by purchasing the artwork.
The Buyer may display the artwork for personal enjoyment but may not reproduce, publish, use commercially, or create derivative works without written permission from the Artist.
7. Resale
Unless otherwise agreed in writing, the Buyer may resell the physical artwork.
However, resale of the object does not grant any right to reproduce or exploit the artwork itself.
8. Limitation of Liability
To the fullest extent permitted by law, the Artist shall not be liable for any incidental, consequential, or special damages arising out of the sale, use, or inability to use the artwork.
9. Governing Law
These Terms are governed by the laws of the State of Hawaiʻi.
Collector Transmission Agreement
The Buyer acknowledges that, in addition to the artwork, a private written transmission from the Artist may be provided as part of the artwork’s lineage. This text remains the intellectual property of the Artist and may be reproduced only with written permission.
